1. Introduction and Agreement to Terms

Welcome to Callaina Maldives Travel & Tours! These Terms and Conditions (“Terms”) govern your use of the Callaina Maldives website (the “Website”) and the services (“Services”) offered by Callaina Maldives Travel & Tours (“Callaina Maldives,” “we,” “us,” or “our”). By accessing or using our Website and Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must not use our Website or Services.

These Terms constitute a legally binding agreement between you and Callaina Maldives.

2. Definitions

  • “Client,” “You,” “Your”: Refers to the individual or entity accessing or using our Website and Services, including anyone who makes a booking through Callaina Maldives.

  • “Services”: Refers to all travel-related services offered by Callaina Maldives, including but not limited to, tour packages, accommodation bookings, transfers, excursions, and any other travel arrangements.

  • “Booking”: Refers to any reservation for travel services made by you through Callaina Maldives.

  • “Supplier”: Refers to any third-party provider of travel services, including but not limited to hotels, resorts, airlines, transfer operators, and tour operators.

3. Booking and Payment

3.1. Inquiry and Confirmation

  1. Inquiry: You may browse our packages and submit an inquiry through our Website, providing your travel details, preferences, and contact information.

  2. Availability and Quote: Upon receiving your inquiry, we will check the availability of the requested services and provide you with a customized quote, including the best available prices at that time. Please note that prices are subject to change until a booking is confirmed.

  3. Provisional Booking: In most cases, we can make a provisional booking of your chosen resort/services without requiring an advance payment at the inquiry stage.

  4. Confirmation: A booking is only confirmed once Callaina Maldives sends you a formal booking confirmation email, detailing your itinerary, services included, total price, and applicable payment and cancellation policies. This confirmation will typically be sent within 24-48 hours of our successful booking with the Suppliers.

3.2. Payment

  1. Payment Schedule: The confirmation email will specify the payment due date(s). Full payment or a deposit, as detailed in your booking confirmation, is required to secure your reservation.

  2. Accepted Payment Methods: We accept payment via bank transfer or other methods as specified in your booking confirmation. For security reasons, we may request sensitive payment details, such as credit card information, via secure channels (e.g., fax or a secure payment gateway link, if applicable).

  3. BML Payment Gateway: Payments for purchases are processed securely through the Bank of Maldives (BML) Payment Gateway. By proceeding with a payment, you agree to abide by BML’s terms and conditions, as well as our own. We do not collect, process, or store your card details on our website. All sensitive payment information is securely handled by the BML Payment Gateway. We recommend that you retain a copy of your transaction records.

  4. Failure to Pay: Failure to complete payment within the specified timeframe may result in the automatic cancellation of your booking without further notice, and applicable cancellation charges may apply.

  5. Price Guarantee: While we strive to offer the best rates, prices are subject to change by Suppliers until full payment is received. Our “Best Price Guarantee” or price matching policy, if offered, will be subject to specific terms and conditions communicated at the time of inquiry.

4. Cancellations, Amendments, and Refunds

4.1. Cancellation by You

  1. Cancellation Policy: Cancellation policies vary depending on the specific package, accommodation, or service booked. The applicable cancellation terms will be clearly stated in your booking confirmation.

  2. Notification: All cancellation requests must be submitted in writing via email to Callaina Maldives. The effective date of cancellation will be the date we receive your written notification during our working hours.

  3. Cancellation Charges: Depending on when the cancellation request is received relative to your arrival/service start date, cancellation charges will apply. These charges can range from a percentage of the total booking cost to 100% of the cost (e.g., for cancellations within a short period of arrival, or for non-refundable services).

  4. No-Show: In the event of a “no-show” (failure to arrive without prior notification), the full booking amount will be charged, and no refunds will be issued.

4.2. Amendments by You

  1. Amendment Policy: Requests for amendments (changes to dates, names, room types, etc.) must be submitted in writing via email.

  2. Fees: Amendments are subject to availability, the Supplier’s terms, and may incur additional charges or penalties from Callaina Maldives and/or the Supplier.

  3. “Zero Amendment Charges”: If offered, “Zero Amendment Charges” may apply only to our service fees and not to any charges imposed by third-party Suppliers.

4.3. Refunds

  1. Eligibility: Refund eligibility is determined solely based on the cancellation policy associated with your specific booking.

  2. Processing: Refunds, if applicable, will be processed using the same method of payment used for the original transaction.

  3. Processing Time: Processing times for refunds may vary depending on the payment provider and banking institutions involved. It may take up to 4-12 weeks for the refund to appear in your account. We appreciate your patience during this period.

4.4. Cancellation or Amendment by Callaina Maldives / Supplier

In rare circumstances, Callaina Maldives or our Suppliers may need to cancel or make significant changes to your booking due to unforeseen circumstances beyond our control (e.g., unavailability of accommodation, weather conditions, operational issues). In such cases:

  • We will notify you as soon as possible.

  • We will endeavor to offer you alternative arrangements of comparable standard and price, if available.

  • If we cannot offer a suitable alternative, or if you do not accept the alternative offered, you may be entitled to a full refund for the cancelled service, excluding any non-recoverable costs incurred by us.

  • Callaina Maldives will not be liable for any additional costs incurred by you (e.g., international flights, other travel arrangements) due to such cancellations or changes.

5. Travel Documents and Requirements

  1. Passport and Visa: You are solely responsible for ensuring you have a valid passport, any necessary visas, and comply with all entry, exit, health, and other governmental requirements for your travel to the Maldives and any transit countries.

  2. Health Requirements: You are responsible for checking and complying with all health requirements and recommendations for your travel, including vaccinations or medical tests.

  3. Assistance: While Callaina Maldives may provide guidance and assistance with visa processes and travel checklists, this is a complimentary service, and we do not guarantee the issuance of visas or accept liability for any issues arising from your non-compliance with travel requirements.

6. Travel Insurance

Callaina Maldives strongly recommends that all clients obtain comprehensive travel insurance at the time of booking. This insurance should cover, but not be limited to, trip cancellation, interruption, medical emergencies, personal liability, loss of baggage, and unforeseen circumstances. Your travel insurance is your primary protection against financial losses due to unforeseen events.

7. Our Role as an Agent

Callaina Maldives acts as an agent for various third-party Suppliers. We arrange travel services on your behalf. While we exercise care in selecting reputable Suppliers, we do not own, manage, or operate any aircraft, hotels, resorts, or transportation services. Therefore:

  • Your contract for the actual travel services is with the respective Supplier(s).

  • We are not responsible for the acts, omissions, negligence, or breach of contract of any Supplier or any third party.

  • Any claims for issues arising directly from the services provided by the Supplier must be made against the Supplier.

8. Liability and Disclaimers

  1. Limitation of Liability: To the maximum extent permitted by law, Callaina Maldives shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Website or Services; (b) any conduct or content of any third party on the Services; (c) any content obtained from the Services; and (d) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

  2. Accuracy of Information: While we strive to ensure the accuracy of information provided on our Website regarding resorts, packages, and services, such information is largely based on details provided by Suppliers and is subject to change. Callaina Maldives does not guarantee the accuracy, completeness, or up-to-dateness of this information.

  3. Force Majeure: Callaina Maldives shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay is caused by circumstances beyond our reasonable control (“Force Majeure Event”), including but not limited to: acts of God, natural disasters, epidemics, pandemics, government restrictions, acts of war or terrorism, civil unrest, strikes, technical failures, or transportation disruptions. In such cases, we will endeavor to provide alternatives or refunds as per the Supplier’s policies, but no additional compensation will be provided.

9. User Conduct

You agree to use our Website and Services only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use and enjoyment of the Website. Prohibited conduct includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our Website.

10. Intellectual Property

All content on the Callaina Maldives Website, including text, graphics, logos, images, software, and the compilation thereof, is the property of Callaina Maldives or its content suppliers and protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website without our prior written consent.

11. Privacy Policy

Your use of our Website and Services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information. 14. Severability
